After six years of preparatory work the Draft Convention was proposed by the ILA Space Law Committee to the 1984 Paris Conference of the International Law Association (ILA) where it was discussed and approved.

The development of the Draft Convention was initiated in 1978 when the Manila Conference of the ILA recommended that the Space Law Committee study the problem of the settlement of space law disputes. This opened a discussion both in the ILA Space Law Committee and in the International Institute of Space Law. On the basis of these discussions and research efforts the 1982 Montreal Conference of the ILA recommended that the Space Law Committee start the formulation of a Draft Convention on the Settlement of Space Law Disputes. A first draft was presented to members of the ILA Space Law Committee and to members of the International Institute of Space Law. A number of comments were received from experts all over the world who welcomed the draft in principle. Thus the First Draft of the Convention on the Settlement of Space Law Disputes was proposed to the 1984 Paris Conference of the ILA where Prof. Böckstiegel was asked to prepare a final draft in consultation with members of the ILA Space Law Committee. Another major initiative during that period of time was the Munich Colloquium on "Settlement of Space Law Disputes" organized in 1979 by the Institute of Air and Space Law at Cologne University in cooperation with the ILA Space Law Committee, the International Institute of Space Law and the German Society for Aeronautics and Astronautics. The results of this Conference are published in the proceedings "Settlement of Space Law Disputes", edited by Karl-Heinz Böckstiegel, Cologne, 1980.
